The important thing to know as a home buyer is that you have the option to choose representation in the real estate transaction that is independent and exclusive. Why should a buyer choose to have buyer representation in a real estate transaction?
Loyalty - The real estate agent bound by a buyer’s representation agreement must act in the best interest of the buyer throughout the real estate transaction.
Obedience - The real estate agent must follow the instruction of the buyer he/she represents as long as the instruction is lawful and not outside the scope of the real estate agent’s expertise.
Disclousre of all material facts from beginning to end - A few examples of disclosure by the realtor include, but are not limited to: the relationship the agent may have either with the listing agent or parties involved in the real estate transaction, the existence of other offers made known to the buyer’s agent, the status of the earnest money and option money checks written to accompany the offer/executed contract, commission splits with broker, and the importance of provisions in the contract.
Confidentiality - When you have a Realtor providing buyer’s representation, you can ensure that any discussions, facts or other important information can be shared in confidentiality. Confidentiality as the buyer is what you should expect when being represented by a Realtor.
Reasonable Skill and Care - You can ensure that you come to a reasonable purchase price after reviewing a comparative market analysis prepared by your Realtor representative. Material facts concerning the property and it’s condition to be disclosed to the buyer (this includes obtaining the seller’s disclosure document from the seller). Also making the buyer aware of the options to have the property inspected including both a home inspection and pest inspection during the option period of the contract.
